Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Leadket LLC (“LeadKet,” “we,” “us”). They govern your use of leadket.co, our forms and booking calendar, and the calls, texts and emails we send (together, the “Website”). By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

LeadKet provides appointment setting services to remodeling and home improvement contractors in the United States. We run advertising campaigns, contact homeowners who respond, qualify them against criteria agreed with the contractor, and book appointments into the contractor's calendar.

Information on the Website, including pricing, descriptions and case studies, is for general information. Any engagement with LeadKet is governed by a separate written agreement or order confirmation between LeadKet and the client. If that agreement conflicts with these Terms, the agreement controls.

As published on the Website, our standard pricing is:

• $350 per booked appointment, with advertising spend included; or
• $150 per booked appointment when the client pays the advertising spend directly, with a minimum ad spend of $70 per day.

There is no agency fee, setup fee or retainer. Appointments are billed when booked. An appointment where the homeowner does not show up is refunded, according to the process set out in the client agreement. What counts as a qualified appointment is defined in writing with each client before campaigns start.

Case studies and results on the Website describe past campaigns. Results vary by market, niche, budget, offer and the client's own sales process, and past results do not guarantee future results.

• Hold any licenses, registrations and insurance required to perform the work you sell.
• Provide accurate information about your services, service area, pricing and qualification criteria.
• Attend booked appointments or reschedule them promptly and professionally.
• Use homeowner information only to serve that homeowner, and comply with applicable consumer protection, privacy and telemarketing laws.
• Honor any opt-out or do-not-contact request a homeowner makes.

If you check the consent box on one of our forms or otherwise agree to receive calls and texts from LeadKet, we may contact you at the number you provided about your inquiry, your appointment and our services, including with automated technology and prerecorded or artificial voice messages.

• Carriers are not liable for delayed or undelivered messages.

You agree to give us a phone number that you own or are authorized to use, and to tell us if you stop using it. We do not sell or share text messaging consent or phone numbers with third parties for their marketing.

You agree not to:

• Submit false information or information about another person without their permission.
• Use the Website for any unlawful purpose or to send spam.
• Interfere with the Website's security or operation, or try to access systems you are not authorized to use.
• Copy, scrape or republish the Website's content for commercial purposes without our written permission.

The Website and its content, including text, design, graphics, logos, data compilations and software, belong to LeadKet or its licensors and are protected by intellectual property laws. Third-party names, logos and trademarks, including those of Meta, Clutch, Angi, HomeAdvisor, Thumbtack and Modernize, belong to their owners. Comparisons with other providers are based on publicly available information and may change.

The Website uses and links to third-party services, such as our booking calendar, form processor and advertising platforms. Their own terms and privacy policies apply. Home-value data on location pages comes from the Zillow Home Value Index and is provided for general information only.

The Website is provided “as is” and “as available.” To the fullest extent permitted by law, LeadKet disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, error-free or free of harmful components.

To the fullest extent permitted by law, LeadKet will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Website. Our total liability for any claim relating to the Website will not exceed one hundred US dollars ($100). Liability for paid services is governed by the client agreement.

You agree to indemnify and hold LeadKet harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Website or your violation of these Terms or of applicable law.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute relating to these Terms or the Website will be brought in the state or federal courts located in Wyoming, unless the client agreement provides otherwise.

We may update these Terms from time to time by posting a new version on this page with a new effective date. Your continued use of the Website after an update means you accept the updated Terms.
